Applied to export, this <\/em><span style=\"color: #ff0000;\"><strong><em>WSTAX<\/em><\/strong><\/span><em>\u00a0 is essential because it is what will allow the creation, regulation and standardization of the <\/em><span style=\"color: #ff0000;\"><span style=\"color: #0000ff;\"><strong><em>W<\/em><\/strong><\/span><strong><em>ayfair <\/em><\/strong><span style=\"color: #0000ff;\"><strong><em>S<\/em><\/strong><\/span><strong><em>ale <\/em><\/strong><span style=\"color: #0000ff;\"><strong><em>T<\/em><\/strong><\/span><strong><em>ax<\/em><\/strong><\/span><em> in United States, where we saw <a href=\"https:\/\/www.dagtva.com\/wp-content\/uploads\/documents\/wstax\/White-Paper-final-w-App-2-5-20.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">in the MTC document<\/a><\/em><em>, that many discrepancies persist on the application of this law. If the DAGTVA system should not process this <\/em><span style=\"color: #ff0000;\"><strong><em>WSTAX<\/em><\/strong><\/span><strong><em>, <\/em><\/strong><em>as we will see in other tabs of Excel, the desire to obtain a balanced global taxation system would be called into question by its obvious inapplicability in the fifty federated States of United States which represent the first but also nearly a quarter of the world economy. What would not be conceivable either, is that the world&rsquo;s largest economy should be excluded from a shared taxation system when it was precisely at the origin, with <span style=\"background: #ffff00 none repeat scroll 0% 0%;\">what the OECD and the United States are looking for, in the first place, to see the sale taxes returned in the States of consumption<\/span>.<\/em><\/p>\n<p><em>The <\/em><span style=\"color: #ff0000;\"><span style=\"color: #0000ff;\"><strong><em>W<\/em><\/strong><\/span><strong><em>ayfair <\/em><\/strong><span style=\"color: #0000ff;\"><strong><em>S<\/em><\/strong><\/span><strong><em>ale <\/em><\/strong><span style=\"color: #0000ff;\"><strong><em>T<\/em><\/strong><\/span><\/span><strong><em><span style=\"color: #ff0000;\">ax<\/span>,<span style=\"color: #ff0000;\"> it will be the heart of the new possible global tax system<\/span><\/em><\/strong><em> associated <a href=\"https:\/\/www.dagtva.com\/?page_id=7563\" target=\"_blank\" rel=\"noopener noreferrer\">calculation DAGTVA transfer pricing<\/a><\/em><em> and <a href=\"https:\/\/www.dagtva.com\/wp-content\/uploads\/dessins\/us\/wsm_b2b_mkplace_dom-usa_wayfair.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">the slideshow by reference. <\/a><\/em><em>This set could be the future base of the <\/em><span style=\"color: #ff0000;\"><strong><em><span style=\"color: #0000ff;\">W<\/span>orld <span style=\"color: #0000ff;\">S<\/span>ingle <span style=\"color: #0000ff;\">M<\/span>arket<\/em><\/strong><\/span><em>. The subject will be commented on in detail as the presentations progress\u00a0\u00bb.<\/em><\/p>\n<p>Let us return to the application of a <span style=\"color: #ff0000;\"><em><strong>WSTAX<\/strong><\/em><\/span> to the export of <span style=\"color: #ff0000;\"><strong>10%<\/strong><\/span> in <span style=\"color: #0000ff;\"><strong>D10<\/strong><\/span>.<\/p>\n<p><span style=\"color: #800000;\"><strong><u>Consequences in State &lsquo;A&rsquo;<\/u><\/strong><\/span><strong> :<\/strong><\/p>\n<p>We note that by putting <span style=\"color: #ff0000;\"><strong>10%<\/strong><\/span> of <span style=\"color: #ff0000;\"><strong><em>WSTAX<\/em><\/strong><\/span> we realize that it is half of the <span style=\"color: #ff0000;\"><strong>%<\/strong><\/span> of VAT\/TAX to be collected on the sale of <span style=\"color: #ff0000;\"><strong>20%<\/strong><\/span> which was <span style=\"color: #ff0000;\"><strong>330<\/strong><\/span> in <span style=\"color: #0000ff;\"><strong>D26<\/strong><\/span> is now divided into 2 parts equal to <span style=\"color: #ff0000;\"><strong>165<\/strong><\/span> in <span style=\"color: #0000ff;\"><strong>D26<\/strong><\/span> and <span style=\"color: #0000ff;\"><strong>D27<\/strong><\/span>.<\/p>\n<p>The obvious consequence is that a local VAT\/TAX to be collected of <span style=\"color: #ff0000;\"><strong>165<\/strong><\/span> is applied and that the transfer price goes from <span style=\"color: #ff0000;\"><strong>1650<\/strong><\/span> in <span style=\"color: #0000ff;\"><strong>D25<\/strong><\/span> to <span style=\"color: #ff0000;\"><strong>1815<\/strong><\/span> in <span style=\"color: #0000ff;\"><strong>D29<\/strong><\/span> incremented by the same amount.<\/p>\n<p>The <span style=\"color: #ff0000;\"><strong><em>WSTAX<\/em><\/strong><\/span> is reimbursed to the EMN in the payment of the transfer price in <span style=\"color: #0000ff;\"><strong>D33<\/strong><\/span> which cancels out the increase of <span style=\"color: #ff0000;\"><strong>165<\/strong><\/span> in the transfer price previously observed.<\/p>\n<p>As with a <span style=\"color: #ff0000;\"><em><strong>WSTAX<\/strong><\/em><\/span> at <span style=\"color: #ff0000;\"><strong>0%<\/strong><\/span>, the indirect taxation in <span style=\"color: #0000ff;\"><strong>D40<\/strong><\/span> + <span style=\"color: #0000ff;\"><strong>D41<\/strong><\/span>,<span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\"> without increase, is always equal to <\/span><strong><span style=\"color: #ff0000;\">330<\/span>.\u00a0<\/strong><\/p>\n<p><span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\">The <strong><em>WSTAX<\/em><\/strong> is neutral in this part of indirect taxation of the transaction<\/span>.<\/p>\n<p><span style=\"color: #800000;\"><strong>Regarding the company&rsquo;s results:<\/strong><\/span><\/p>\n<p>Logically the <span style=\"color: #ff0000;\"><strong>CIT<\/strong><\/span> on gross profit is unchanged at <span style=\"background: #ffff00 none repeat scroll 0% 0%;\"><span style=\"color: #ff0000;\"><strong>150 regardless of the rate of <\/strong><em><strong>WSTAX<\/strong><\/em><\/span><strong><span style=\"color: #ff0000;\"> applied in the State of production!<\/span><\/strong><\/span><\/p>\n<p>With the credit of <span style=\"color: #ff0000;\"><strong>165<\/strong><\/span> included in the payment of the transfer price by the subsidiary of the market State, the receipts increase accordingly, which causes an increase in the original profit of the same sum from <span style=\"color: #ff0000;\"><strong>170<\/strong><\/span> to <span style=\"color: #ff0000;\"><strong>335<\/strong><\/span>.<\/p>\n<p><span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\"><strong>Yes, you read that right ! An export <\/strong><em><strong>WSTAX<\/strong><\/em><strong> increases local profit in State &lsquo;A&rsquo;!<\/strong><\/span><\/p>\n<p>It follows that the original profit ratio of <span style=\"color: #ff0000;\"><strong>10.18%<\/strong><\/span> is increasing to <span style=\"color: #ff0000;\"><strong>18.26%<\/strong><\/span> and causes the taxation of a residual profit of <span style=\"color: #ff0000;\"><strong>6.26%<\/strong><\/span> or <strong><span style=\"color: #ff0000;\">21<\/span>.<\/strong> The whole resulting in an increase in taxation direct from <span style=\"color: #ff0000;\"><strong>150<\/strong><\/span> to <strong><span style=\"color: #ff0000;\">171<\/span>,<\/strong> which increases <span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\">the profit after <strong>CIT<\/strong><\/span> from <span style=\"color: #ff0000;\"><strong>170<\/strong><\/span> to <strong><span style=\"color: #ff0000;\">314<\/span>!<\/strong><\/p>\n<p>Profit over revenue increased from <span style=\"color: #ff0000;\"><strong>10.18%<\/strong><\/span> to <span style=\"color: #ff0000;\"><strong>17.11%<\/strong><\/span>. <span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\">The exporting entity of the MNE is not going to complain about such a situation which turns out to be to its total advantage.<\/span><\/p>\n<p><span style=\"color: #800000;\"><strong><span style=\"text-decoration: underline;\">Note<\/span>:<\/strong><\/span> If we wanted to perfectly balance the ratio of<span style=\"color: #ff0000;\"><em><strong> profit \/ revenue<\/strong><\/em><\/span> at<span style=\"color: #ff0000;\"><strong> 11.51%<\/strong><\/span> (in hidden tabs) that would apply a <span style=\"color: #ff0000;\"><strong><em>WSTAX<\/em><\/strong><\/span> to<strong><span style=\"color: #ff0000;\"> 1.52%<\/span>. <\/strong>It should be added to the fact that the subsidiary in &lsquo;B&rsquo; is obliged to pay the transfer price so that the MNE can export its productions and receives them in the market State, normally has no impact on the general accounts of the MNE, what comes out of the right pocket goes into the left pocket!<\/p>\n<p><strong><span style=\"text-decoration: underline; color: #800000;\">With regard to the tax revenues of production State &lsquo;A&rsquo;<\/span> :<br \/>\n<\/strong><\/p>\n<p>The <span style=\"color: #ff0000;\"><strong><em>WSTAX<\/em><\/strong><\/span> was created in <span style=\"color: #0000ff;\"><strong>D10<\/strong><\/span> and <strong><span style=\"color: #0000ff;\">D26<\/span> <\/strong>in order to be returned to the market State from the <span style=\"color: #0000ff;\"><strong>D64<\/strong><\/span> to be transformed into <span style=\"color: #ff0000;\"><strong><em><span style=\"color: #0000ff;\">W<\/span>ayfair <span style=\"color: #0000ff;\">S<\/span>ale <span style=\"color: #0000ff;\">T<\/span>ax<\/em><\/strong><\/span> in <span style=\"color: #0000ff;\"><strong>D67<\/strong><\/span> to be returned in the form of credit in <span style=\"color: #0000ff;\"><strong>I67 <\/strong><\/span>in the State of market &lsquo;B&rsquo;.<\/p>\n<p>We can see that the transfer of this sale taxes created to comply with American law is returned <span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\"><strong>from a taxation authority to another taxation authority<\/strong><\/span> and in no case from a company. The MNE, which is not involved in the process of this part of the transaction, is a winner and will not oppose the application of this <span style=\"color: #ff0000;\"><strong><em>WSTAX<\/em><\/strong><\/span>. But there will be no &lsquo;loser&rsquo; in this production part of the transaction because, if the production State has to refund this tax, it has collected the same sum in <span style=\"color: #0000ff;\"><strong>D41<\/strong><\/span> and <span style=\"color: #0000ff;\"><strong>D65<\/strong><\/span> whereas if there had been a <span style=\"color: #ff0000;\"><strong><em>WSTAX<\/em><\/strong><\/span> at <strong><span style=\"color: #ff0000;\">0%<\/span>,<\/strong> i.e. no export tax,<span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\"> he would have lost double, in order to respect an American law, that is <strong>330<\/strong>. <strong>Tax efforts are therefore shared at this level between the two States involved in the transaction<\/strong>.<\/span><\/p>\n<p><em>We can add that the concept of VAT, even if it is mentioned on the invoice and in this \u201cproducer\u201d column, does not yet have a real existence, we are still at the stage of taxing a sold production. The States which will have to apply the restitution of this production tax will want, as specified above, <span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\">that the tax efforts be shared between States by returning only half of what is taxed (in this special example which not reflect a reality). <strong>It can be an argument to find an agreement on negotiations in other cases studyed in this proposition.<\/strong><\/span><\/em><\/p>\n<p>But State &lsquo;A&rsquo; loses a little less than these <span style=\"color: #ff0000;\"><strong>165<\/strong><\/span> returned because it received <span style=\"color: #ff0000;\"><strong>21<\/strong><\/span> of taxable residual profits, i.e. <span style=\"color: #ff0000;\"><strong>480 &#8211; 336 = 144<\/strong><\/span>.<\/p>\n<p>Conclusion of the application of the <span style=\"color: #ff0000;\"><strong><em>WSTAX<\/em><\/strong><\/span> in the State of production, all can be relatively satisfied except perhaps, at the time, the tax authorities who had to return the <strong><em><span style=\"color: #ff0000;\"><span style=\"color: #0000ff;\">W<\/span>ayfair <span style=\"color: #0000ff;\">S<\/span>ale<span style=\"color: #0000ff;\"> T<\/span>ax<\/span>. <\/em><\/strong>They must think that they will also receive it from other States, this mitigating that! <span class=\"tlid-translation translation\" lang=\"en\" style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\"><span class=\"\" title=\"\">Automated clearing house would balance between that it was returned and received in taxes in each State, to send only the difference toward States.<\/span><\/span><\/p>\n<p><span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\"><strong>But I hear from here the critics who say that it is the subsidiary of the EMN in the market state which paid for this advantageous situation in the production&rsquo; State !<\/strong><\/span><\/p>\n<p><span style=\"color: #ff0000;\"><strong>Well that&rsquo;s not true!<\/strong><\/span><\/p>\n<p><span style=\"color: #800000;\"><strong><span style=\"text-decoration: underline;\">We will now look at the rest of the Market State transaction<\/span>.<\/strong><\/span><\/p>\n<p><span style=\"color: #800000;\">Make the two hidden columns reappear with the horizontal cursor of Excel.<\/span><\/p>\n<p>Applying a <span style=\"color: #ff0000;\"><strong><em>WSTAX<\/em><\/strong><\/span> at <span style=\"color: #ff0000;\"><strong>10%<\/strong><\/span> the transfer price goes from <span style=\"color: #ff0000;\"><strong>1650<\/strong><\/span> in <span style=\"color: #0000ff;\"><strong>D25<\/strong><\/span> to <span style=\"color: #ff0000;\"><strong>1815<\/strong><\/span> in <span style=\"color: #0000ff;\"><strong>D29<\/strong><\/span> and <strong><span style=\"color: #0000ff;\">I18<\/span> ,<\/strong> incremented by the same amount in State &lsquo;B&rsquo;.<\/p>\n<p>The deductible TAX\/VAT on the transfer price paid increases from <span style=\"color: #ff0000;\"><strong>330<\/strong><\/span> to <span style=\"color: #ff0000;\"><strong>363<\/strong><\/span> and if we add the <span style=\"color: #ff0000;\"><strong>20<\/strong> <\/span>of deductible TAX\/VAT on purchases in State &lsquo;B&rsquo;, <span style=\"color: #ff0000;\"><strong>383<\/strong><\/span> of TAX\/VAT is returned to the subsidiary. As specified in the comments on the &lsquo;ideal&rsquo; situation, out of these <span style=\"color: #ff0000;\"><strong>383<\/strong><\/span> , a levy of <span style=\"color: #ff0000;\"><strong>330<\/strong><\/span> in <span style=\"color: #0000ff;\"><strong>D40<\/strong><\/span> and <span style=\"color: #0000ff;\"><strong>D41<\/strong><\/span> (in State &lsquo;A&rsquo;) <span style=\"color: #ff0000;\"><strong>165<\/strong><\/span> are paid by the deductible TAX\/VAT returned by State &lsquo;B &lsquo;on the purchase of the transfer price. <strong><span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\">We see that all indirect taxation of MNE in State &lsquo;A&rsquo; is paid by restitution of that in State &lsquo;B&rsquo;<\/span>.<\/strong><\/p>\n<p><span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\"><strong>With DAGTVA, it is the power of the <em>VAT Tax System<\/em> applied internationally inside MNEs.<br \/>\n<\/strong><\/span><\/p>\n<p>It can also be seen in <span style=\"color: #0000ff;\"><strong>I49<\/strong><\/span> that <span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\"><strong>the initial profit of 500 is invariable whatever the rate of <\/strong><em><strong>WSTAX<\/strong><\/em><strong> applied in the State of production!<\/strong><\/span><\/p>\n<p>We can also see that the initial profit ratio varies very little from <span style=\"color: #ff0000;\"><strong>11.60%<\/strong><\/span> to <span style=\"color: #ff0000;\"><strong>11.01% <\/strong><\/span>being in both cases less than the <span style=\"color: #ff0000;\"><strong>12%<\/strong><\/span> above which the residual profits are taxed, which does not modify the <span style=\"color: #ff0000;\"><strong>Total CIT<\/strong><\/span> which remains at <span style=\"color: #ff0000;\"><strong>195<\/strong><\/span>. The <strong><span style=\"color: #339966;\">profit after CIT<\/span> <span style=\"color: #ff0000;\">is therefore invariable at 500<\/span>.<\/strong> The <span style=\"color: #339966;\"><strong>profit \/ market price<\/strong><\/span> ratio is very little impacted by the <span style=\"color: #ff0000;\"><strong><em>WSTAX<\/em><\/strong><\/span> from <span style=\"color: #ff0000;\"><strong>11.60%<\/strong><\/span> to <span style=\"color: #ff0000;\"><strong>11.01%<\/strong><\/span>.<\/p>\n<p><span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\"><strong>The <\/strong><em><strong>WSTAX<\/strong><\/em><strong> does not impact the direct taxation of the subsidiary with a total CIT which remains unchanged at 195.<\/strong><\/span><\/p>\n<p><span style=\"color: #800000;\"><strong><span style=\"text-decoration: underline;\">Question<\/span>:<\/strong><\/span> <span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\">So who pays this in State &lsquo;B&rsquo; the <strong><em>WSTAX<\/em><\/strong> ?<\/span><\/p>\n<p><span style=\"color: #800000;\"><strong><span style=\"text-decoration: underline;\">Answer<\/span>:<\/strong><\/span>\u00a0 <span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\"><strong>It is State &lsquo;B&rsquo; which pays the <\/strong><em><strong>WSTAX<\/strong><\/em><strong> with deductible TAX\/VAT <\/strong><em><strong>,<\/strong><\/em><strong> but which is reimbursed on the payment of the market price <\/strong><em><strong>,<\/strong><\/em><strong> by the TAX\/VAT to be collected on the sale.<\/strong><\/span><\/p>\n<p><span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\"><strong>In no case does the subsidiary of the EMN pay this <\/strong><em><strong>WSTAX<\/strong><\/em><strong> ! MNEs should not be opposed to this system of taxation!<\/strong><\/span><\/p>\n<p>To check this, the subsidiary differential TAX\/VAT pass from <span style=\"color: #ff0000;\"><strong>660<\/strong><\/span> &#8211; <span style=\"color: #ff0000;\"><strong>350<\/strong><\/span> = <span style=\"color: #ff0000;\"><strong>310<\/strong><\/span> to <span style=\"color: #ff0000;\"><strong>693<\/strong><\/span> &#8211; <span style=\"color: #ff0000;\"><strong>383<\/strong><\/span> = <strong><span style=\"color: #ff0000;\">310<\/span>, <\/strong>nothing change, which lets say the <span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\"><strong><em>WSTAX<\/em> does not impact the indirect taxation<\/strong><\/span> of the subsidiary in the market State.<\/p>\n<p>The market price remains within <span style=\"color: #ff0000;\"><strong>5%<\/strong><\/span> of the <strong><span style=\"color: #ff0000;\">arm&rsquo;s length standard<\/span><\/strong>, admittedly with an increase from <span style=\"color: #ff0000;\"><strong>3960<\/strong><\/span> to <span style=\"color: #ff0000;\"><strong>4158<\/strong><\/span> in this in theorical context.<\/p>\n<p><span style=\"color: #800000;\"><strong><span style=\"text-decoration: underline;\">With regard to the tax revenues of Market State &lsquo;B&rsquo;<\/span>:<\/strong><\/span><\/p>\n<p>TAX\/VAT receipts go from <span style=\"color: #ff0000;\"><strong>660<\/strong><\/span> to <span style=\"color: #ff0000;\"><strong>858<\/strong><\/span> with the <span style=\"color: #ff0000;\"><strong>165<\/strong><\/span> of the <span style=\"color: #ff0000;\"><strong><em><span style=\"color: #0000ff;\">W<\/span>ayfair <span style=\"color: #0000ff;\">S<\/span>ale <span style=\"color: #0000ff;\">T<\/span>ax<\/em><\/strong><\/span> returned, <span style=\"color: #ff0000;\"><strong>i.e. a 30% increase! <\/strong><\/span>We will see in other tabs and sections that this very significant increase will be beneficial for modest economies.<\/p>\n<p>With the <strong><em><span style=\"color: #ff0000;\">WSTAX<\/span>,<\/em><\/strong> the <span style=\"color: #ff0000;\"><strong>TOTAL CIT<\/strong><\/span> not varying to <strong><span style=\"color: #ff0000;\">195<\/span>,<\/strong> the increase in total revenue from <span style=\"color: #ff0000;\"><strong>855<\/strong><\/span> to <strong><span style=\"color: #ff0000;\">1053<\/span>, <\/strong>that is to say a good of more than <span style=\"color: #ff0000;\"><strong>23.1%<\/strong><\/span> , is done only on the indirect taxation which is paid, ultimately, by the ultimate consumer in the market State.<\/p>\n<p><span style=\"color: #800000;\"><strong><span style=\"text-decoration: underline;\">Conclusions<\/span>:<\/strong><\/span><\/p>\n<p>To conclude on the consequences of this <span style=\"color: #ff0000;\"><em><strong>WSTAX<\/strong><\/em> <\/span>, admittedly under balanced fiscal conditions, if it allows States to comply with American law, it has very little impact on MNEs.
