These results will evolve by modifying the variables in: &lsquo;B&rsquo; and &lsquo;A-B&rsquo;. &lsquo;A-B&rsquo; being automatically modified by the fiscal parameters of State &lsquo;B&rsquo;.<\/p>\n<p>Go to the seven tab &lsquo;<span style=\"color: #0000ff;\"><strong>Distrib 8% EN &#8211; 7<\/strong><\/span>&lsquo; of Excel: <a href=\"https:\/\/www.dagtva.com\/wp-content\/uploads\/documents\/wstax\/egalisation_des_taxes.xls\" target=\"_blank\" rel=\"noopener noreferrer\">egalisation_des_taxes.xls(<span style=\"color: #800000;\">1<\/span>)<\/a><\/p>\n<p><span style=\"color: #800000;\">1<em> <span class=\"tlid-translation translation\" lang=\"en\"><span class=\"\" title=\"\"><strong><span style=\"text-decoration: underline;\">Note<\/span>:<\/strong> to have the correct opening of the file, please download the document on your computer before opening it, do not open directly.<\/span><\/span><\/em><\/span><\/p>\n<p><span style=\"color: #800000;\"><strong><span style=\"text-decoration: underline;\">With the following State &lsquo;B&rsquo; fiscal parameters<\/span> :<\/strong><\/span><\/p>\n<p><span style=\"color: #ff0000;\">The variables modified for &lsquo;B&rsquo; therefore &lsquo;A-B&rsquo; are:<\/span><\/p>\n<p>&#8211; The corporate tax rate: <span style=\"color: #ff0000;\"><strong>8%<\/strong><\/span><\/p>\n<p>&#8211; the local TAX\/VAT rate: <span style=\"color: #ff0000;\"><strong>8%<\/strong><\/span><\/p>\n<p>All other parameters remain unchanged.<\/p>\n<p><span style=\"color: #800000;\"><strong><u>Comments<\/u> \u00a0:<\/strong><\/span><\/p>\n<p><span style=\"color: #800000;\"><span style=\"text-decoration: underline;\"><strong>In production State &lsquo;A&rsquo;<\/strong><\/span> :<\/span><\/p>\n<p>Nothing changes, the <span style=\"color: #ff0000;\"><strong><em>WSTAX<\/em><\/strong><\/span> being at <strong>&lsquo;<span style=\"color: #ff0000;\">0%<\/span>&lsquo;<\/strong> , the tax to be returned to the State of consumption not being levied on production as explained in the comments on the &lsquo;<span style=\"text-decoration: underline;\"><em><a href=\"https:\/\/www.dagtva.com\/wp-content\/uploads\/documents\/wstax\/egalisation_des_taxes.xls\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: #0000ff; text-decoration: underline;\">Transac-base EN &#8211; 6<\/span><\/a><\/em><\/span>&lsquo; tab, the amount of the<span style=\"color: #ff0000;\"> <em><strong><span style=\"color: #0000ff;\">W<\/span>ayfair <span style=\"color: #0000ff;\">S<\/span>ale <span style=\"color: #0000ff;\">T<\/span>ax<\/strong><\/em><\/span> is at <strong>&lsquo;<span style=\"color: #ff0000;\">0<\/span>&lsquo;<\/strong>.<\/p>\n<p><span style=\"color: #800000;\"><span style=\"text-decoration: underline;\"><strong>In distribution\/market State &lsquo;B&rsquo;<\/strong><\/span> :<\/span><\/p>\n<p>With these new parameters, the <span style=\"color: #0000ff;\"><strong>I54<\/strong><\/span> margin ratio of <span style=\"color: #ff0000;\"><strong>11.60%<\/strong><\/span> increases to <span style=\"color: #ff0000;\"><strong>13.67%<\/strong><\/span>. The total <span style=\"color: #ff0000;\"><strong>CIT<\/strong><\/span> goes from <strong>195<\/strong> to <span style=\"color: #ff0000;\"><strong>53<\/strong><\/span>, the profit after <span style=\"color: #ff0000;\"><strong>CIT<\/strong><\/span> from <span style=\"color: #ff0000;\"><strong>500<\/strong><\/span> to <span style=\"color: #ff0000;\"><strong>490<\/strong><\/span> varies little: <strong><span style=\"color: #ff0000;\">0,2%<\/span><\/strong>.<\/p>\n<p>The market price is a little higher, it deviates reasonably only by <span style=\"color: #ff0000;\"><strong>3.57%<\/strong><\/span> from the reference price, which could represent an equivalent local production, this difference, even if it is financially positive, remains to the disadvantage of the MNE facing a local production.<\/p>\n<p><span style=\"color: #ff0000;\"><span style=\"background: #ffff00 none repeat scroll 0% 0%;\">The market price remains within an arm&rsquo;s length margin of less than <strong>5%<\/strong><\/span> .<\/span><\/p>\n<p>The differential of the margin ratio of <span style=\"color: #ff0000;\"><strong>10.18%<\/strong><\/span> in &lsquo;A&rsquo; &#8211; <span style=\"color: #0000ff;\"><strong>D54<\/strong><\/span> and <span style=\"color: #ff0000;\"><strong>13.67%<\/strong> <\/span>in &lsquo;B&rsquo;- <span style=\"color: #0000ff;\"><strong>I54 <\/strong><\/span> shows only a difference of <span style=\"color: #ff0000;\"><strong>3.50%<\/strong><\/span> in <strong><span style=\"color: #0000ff;\">F54<\/span>,<\/strong> still very balanced in favor of the subsidiary in&rsquo; B &lsquo;.<\/p>\n<p><span style=\"background: #ffff00 none repeat scroll 0% 0%;\">After these first results, one might think that nothing has really changed, however it appears some important consequences:<\/span><\/p>\n<p><span style=\"color: #ff0000;\"><strong>A first drawback for the MNE<\/strong><\/span> which, even if it pays less total <span style=\"color: #ff0000;\"><strong>CIT<\/strong><\/span> with<span style=\"color: #ff0000;\"><strong> 203<\/strong><\/span> instead of<span style=\"color: #ff0000;\"><strong> 266<\/strong><\/span>, with a differential of<span style=\"color: #ff0000;\"><strong> 63<\/strong><\/span>, overall gains less with<span style=\"color: #ff0000;\"> <strong>660 <\/strong><\/span> in <span style=\"color: #0000ff;\"><strong>K53<\/strong><\/span> than a full local production at <span style=\"color: #ff0000;\"><strong>821<\/strong><\/span> in <span style=\"color: #0000ff;\"><strong>N53<\/strong><\/span> with a differential of <span style=\"color: #ff0000;\"><strong>161<\/strong><\/span> to its disadvantage requires having a more complex management of the distribution of activities with a negative profit balance for the transaction at <span style=\"color: #ff0000;\"><strong>-98<\/strong><\/span> compared to a complete local production whose profit-to-market ratio is <span style=\"color: #ff0000;\"><strong>24.56%<\/strong><\/span><\/p>\n<p><span style=\"color: #ff0000;\"><strong>A second disadvantage for the MNE<\/strong><\/span> with the compulsory payment of the transfer price by the subsidiary in &lsquo;B&rsquo;, which that will imply, as the<span style=\"color: #ff0000;\"><strong><em> WSTAX<\/em><\/strong><\/span> being at<strong> &lsquo;<span style=\"color: #ff0000;\">0%<\/span>&lsquo;,<\/strong> a levy in <span style=\"color: #0000ff;\"><strong>D40<\/strong><\/span> of <span style=\"color: #ff0000;\"><strong>330<\/strong><\/span> of the TAX\/VAT to be collected defined in <span style=\"color: #0000ff;\"><strong>D26<\/strong><\/span>. This VAT included in the payment can only be refunded in the purchase and deductible TAX\/VAT of the subsidiary in &lsquo;B&rsquo; up to the TAX\/VAT rate of <span style=\"color: #ff0000;\"><strong>8%<\/strong><\/span> applied in &lsquo;B&rsquo; , i.e. <span style=\"color: #ff0000;\"><strong>132<\/strong><\/span> in <span style=\"color: #0000ff;\"><strong>I18<\/strong><\/span>. A refund differential lost of <span style=\"color: #ff0000;\"><strong>198<\/strong><\/span> on the transaction that will have to be included in an overall profit balance!<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Third disadvantage for the MNE<\/strong>,<span style=\"background: #ffff00 none repeat scroll 0% 0%;\"> the search for a fiscally advantageous state loses a little more of its interest!<\/span><\/span><\/p>\n<p><span style=\"color: #ff0000;\"><strong>Fourth disadvantage for the MNE. <\/strong><span style=\"background: #ffff00 none repeat scroll 0% 0%;\">This problem will be all the more aggravating for MNEs which carry out activities in States which do not apply VAT!<\/span><\/span><\/p>\n<p>As stated <a href=\"https:\/\/www.dagtva.com\/?page_id=7563\" target=\"_blank\" rel=\"noopener noreferrer\">in the comments on the &lsquo;ideal&rsquo; transaction<\/a> , \u00ab\u00a0<em>MNEs will therefore have every interest in researching the type of VAT environment to be able to benefit from this full reimbursement of indirect taxation in the intra-MNE transaction. <span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\">States which do not apply the principle of this reimbursement would be immediately penalized by MNEs which do not seek to establish themselves there, also forcing non-cooperative States to transparent taxation and <strong>here we enter into binding directives, by default as is stipulated for the pillar 1 &lsquo;Amount C&rsquo;<\/strong>.\u00a0\u00bb<\/span><\/em><\/p>\n<p>Despite these first four disavantages, under the conditions, the proposed table shows a situation which does not seem to give complete satisfaction, <span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\">the MNE can still take the majority of its profits in what looks like a tax haven!<\/span><\/p>\n<p><strong><span style=\"text-decoration: underline;\">But it is not finished<\/span> !<\/strong><\/p>\n<p><span style=\"color: #ff0000;\"><strong>The first but not at least, the drawback for the State of consumption<\/strong><\/span> when it note that <span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\">tax revenues of its State &lsquo;B&rsquo; collapsed from <strong>855<\/strong> to <strong>308,<\/strong> ie: <strong>277% <\/strong> <strong>fall!<\/strong><\/span><\/p>\n<p><span style=\"color: #ff0000;\"><strong>State &lsquo;B&rsquo; is punished for the first time<\/strong><\/span> by applying the <span style=\"color: #ff0000;\"><strong>CIT<\/strong><\/span> and <span style=\"color: #ff0000;\"><strong>TAX\/VAT<\/strong><\/span> rates at<span style=\"color: #ff0000;\"><strong> 8%<\/strong><\/span> .<\/p>\n<p><span style=\"color: #ff0000;\"><strong>State &lsquo;B&rsquo; is punished a second time<\/strong><\/span> as explained above, they also penalize MNEs. <span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\">These will hesitate to set up there to prefer local productions with equivalent taxation in the VAT environment.<\/span><\/p>\n<p><span style=\"color: #800000;\"><strong><u>Other findings<\/u> :<\/strong><\/span><\/p>\n<p>As we saw <a href=\"https:\/\/www.dagtva.com\/?page_id=7563\" target=\"_blank\" rel=\"noopener\"><em>in the &lsquo; ideal &lsquo; transaction<\/em><\/a> in the left column of State &lsquo;A&rsquo;,<em><span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\"> the tax authorities of State &lsquo;A&rsquo; will have to judge only the production part sold<\/span> before comparing it to parameters extraterritorial rights over which, in the name of the free decision of the sovereign foreign states in question, they have no control. <span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\">The control authorities of State &lsquo;B&rsquo; having to judge, for their part, only the purchased production part<\/span> and, perhaps by default, carry out a mutual and cross-check on the regulation of the declared transfer price that can be see in<a href=\"https:\/\/www.dagtva.com\/wp-content\/uploads\/dessins\/us\/wsm_b2b_mkplace_dom-usa_wayfair.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"> the slide show in reference slide 16<\/a>.<\/em><\/p>\n<p>It is very possible that this decision to control the purchased part is not carried out by the tax authorities of State &lsquo;B&rsquo;, which is not fiscally cooperative. <span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\">In this case the tax authorities of State &lsquo;A&rsquo; may suspend the production of export barcodes and thus block the sales transaction until the problem is resolved. <strong>Here we enter a second time into binding guidelines, by default, as is stipulated for the Pillar 1 option &lsquo;Amount C&rsquo;<\/strong> .<\/span><\/p>\n<p><span style=\"color: #ff0000;\"><strong>Another major disavantage for State &lsquo;B&rsquo;<\/strong><\/span>, it must be added that with a rate of<span style=\"color: #ff0000;\"><strong><em> WSTAX <\/em><\/strong><\/span>at <span style=\"color: #ff0000;\"><strong>&lsquo;0%&rsquo;<\/strong><\/span>, <span style=\"background: #ffff00 none repeat scroll 0% 0%; color: #ff0000;\">it then becomes out of the question to transfer a production tax corresponding to the VAT to be collected (in the environment VAT) to the State of the buyer or of consumption, especially if the State of destination is fiscally non-cooperative, which would be a double penalty for the State of production which would have to pay everything out of its own tax revenues.<\/span><\/p>\n<p>We can see a total transparency of the taxation and revenues applied to the transaction.<\/p>\n<p>Both States and MNEs will not be able to conceal these information!<\/p>\n<p style=\"text-align: center;\"><span style=\"color: #0000ff;\">**********<\/span><\/p>\n<p>We can now analyze the opposite situation where it is the State of production which applies fiscal parameters with a <span style=\"color: #ff0000;\"><strong>TAX\/VAT<\/strong><\/span> and an <span style=\"color: #ff0000;\"><strong>CIT<\/strong><\/span> rate at <span style=\"color: #ff0000;\"><strong>8%<\/strong><\/span> in the page:<strong><br \/>\n<\/strong><\/p>\n<p style=\"text-align: center;\"><a href=\"https:\/\/www.dagtva.com\/?page_id=7894\" target=\"_blank\" rel=\"noopener noreferrer\">Produc 8% Wstax 0%<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Proposal for a Global Taxation System \u00a0&#8211;
