It is also important that the new rules are reconciled with existing rules. That is, the new rules should not create distortions and should be effectively applicable to both profits and losses<\/span> (<a href=\"https:\/\/www.dagtva.com\/?page_id=9153\" target=\"_blank\" rel=\"noopener\">RBAtb<\/a>).<\/em><\/p>\n<p>DAGTVA proposes <a href=\"https:\/\/www.dagtva.com\/?page_id=7563\" target=\"_blank\" rel=\"noopener\">a new calculation of transfer prices<\/a>. As stated in many pages of this study, <span style=\"color: #ff0000; background-color: #ffff00;\"><strong>no fraction of the profits will be attributed to a market jurisdiction until they have been quantified and if, once quantified, there will still be a valid reason to tax them<\/strong><\/span>. It is a better distribution of these benefits between the States, during the process of the transaction, that will provide for this. <span style=\"color: #ff0000; background-color: #ffff00;\"><strong>There is therefore nothing to modify on direct taxation<\/strong><\/span>, <span style=\"color: #ff0000; background-color: #ffff00;\"><strong>nothing to negotiate in this area<\/strong><\/span> to obtain an agreement in an <span style=\"color: #0000ff;\"><em><strong><span style=\"color: #ff0000;\">W<\/span>orld <span style=\"color: #ff0000;\">S<\/span>ystem <span style=\"color: #ff0000;\">T<\/span>ax<\/strong><\/em><\/span> as we can read in the <a href=\"https:\/\/www.dagtva.com\/?page_id=8412\" target=\"_blank\" rel=\"noopener\"><em>RBMap<\/em><\/a> page below :<\/p>\n<p><strong>\u201c<span style=\"color: #800000;\"><em>Regarding the distribution of profits:<\/em><\/span><\/strong><\/p>\n<p>As clarified on the <em><a href=\"https:\/\/www.dagtva.com\/?page_id=8389\" target=\"_blank\" rel=\"noopener noreferrer\">RBSju<\/a><\/em> page , <a href=\"https:\/\/www.dagtva.com\/?page_id=7563\" target=\"_blank\" rel=\"noopener noreferrer\">the DAGTVA transfer pricing calculation<\/a> takes into account in the \u00ab <em><span style=\"color: #800000;\"><strong>Amount A<\/strong><\/span>\u00a0<\/em>\u00bb <span style=\"color: #ff0000; background-color: #ffff00;\"><strong>mechanism<\/strong><\/span>, <span style=\"background-color: #ffff00;\">not only residual profits,<span style=\"color: #ff0000;\"> but also profits: standard, routine and intangible<\/span>, from the moment when they are invoiced, <span style=\"color: #ff0000;\"><strong>except that these r\u00e9sidual profits will not be returned to the market jurisdiction<\/strong>. They are treated fiscally during the same time of the transaction<\/span>, this is the advantage of the DAGTVA transactional system <span style=\"color: #ff0000;\">where the totality of the taxation is definitively affected <strong>for the respective shares in each State where the commercial activity takes place<\/strong>.<\/span><\/span><\/p>\n<p><span style=\"color: #ff0000; background-color: #ffff00;\">And we speak here about the <strong>direct taxation<\/strong> which can be levied, as today, without modifying existing local taxation laws.<\/span><\/p>\n<p><span style=\"color: #ff0000;\"><strong>There is therefore nothing to renegotiate in this area of \u200b\u200bresponsibility of each sovereign State, there is no new right to impose and modify direct taxation<\/strong><\/span>, with<span style=\"color: #ff0000;\"><strong> the ease of having a majority international agreement accepted in this area <span style=\"text-decoration: underline;\">and with the probable consent <\/span><\/strong><strong><span style=\"text-decoration: underline;\">of the United States, which has already legislated internally in this area<\/span>.<\/strong><\/span><\/p>\n<p><em>\u00ab\u00a0<span style=\"color: #993300;\">Need to deliver the agreed quantum of profit to market jurisdictions and do so in a way that is simple, avoids double taxation (RBPpi) \u2013 <a style=\"color: #993300;\" href=\"https:\/\/translate.googleusercontent.com\/translate_c?depth=1&amp;hl=en&amp;pto=aue&amp;rurl=translate.google.com&amp;sl=fr&amp;sp=nmt4&amp;tl=en&amp;u=https:\/\/www.dagtva.com\/%3Fpage_id%3D5998&amp;usg=ALkJrhhp2stYS4S6VHrAJV2Xsfk4eiQSXw\" target=\"_blank\" rel=\"noopener\">RBNdi<\/a>), and significantly improves tax certainty (<a style=\"color: #993300;\" href=\"https:\/\/translate.googleusercontent.com\/translate_c?depth=1&amp;hl=en&amp;pto=aue&amp;rurl=translate.google.com&amp;sl=fr&amp;sp=nmt4&amp;tl=en&amp;u=https:\/\/www.dagtva.com\/%3Fpage_id%3D6002&amp;usg=ALkJrhj3yuGmlLDjZZIyZvFUM2l59wXWPA\" target=\"_blank\" rel=\"noopener\">RBRsj<\/a> \u2013 <a style=\"color: #993300;\" href=\"https:\/\/www.dagtva.com\/?page_id=8117\" target=\"_blank\" rel=\"noopener\">PLSju<\/a>) relative to the current position<\/span>\u00a0\u00bb .<\/em> As you will see in <a href=\"https:\/\/www.dagtva.com\/?page_id=7563\" target=\"_blank\" rel=\"noopener\">the new DAGTVA transfer pricing calculation<\/a>, and <a href=\"https:\/\/www.dagtva.com\/wp-content\/uploads\/dessins\/us\/wsm_b2b_mkplace_dom-usa_wayfair.pdf\" target=\"_blank\" rel=\"noopener\">in the slide show in reference<\/a>, the transactional taxation <span style=\"color: #ff0000; background-color: #ffff00;\">not change the tax laws in each State and at no time it is impossible to see the possibility to have a double taxation<\/span>. The DAGTVA process only do the dispatch and the return of a share indirect taxation by effecting a better distribution of production taxes in each jurisdiction of activity.<\/p>\n<p>You will also see the double taxation is avoided, as explained above, and with regard the B\u00b2B transaction within an MNE, the indirect taxation which is levied in a jurisdiction is refunded in the other, <span style=\"color: #ff0000; background-color: #ffff00;\">with no impact of this indirect taxation in the MNE<\/span>. <span style=\"background-color: #ffff00; color: #ff0000;\">For the direct taxation nothing changes as written above<\/span> <span style=\"background-color: #ffff00;\"><strong><span style=\"color: #ff0000;\">until it is decided to do otherwise in the second phase of negotiations of an international taxation system, if return profits are justified by the results of the DAGTVA tax process.<\/span><\/strong><\/span><\/p>\n<p>It emerges from the <a href=\"https:\/\/www.dagtva.com\/?page_id=7563\" target=\"_blank\" rel=\"noopener noreferrer\">DAGTVA transfer pricing calculation<\/a> <span style=\"color: #ff0000; background-color: #ffff00;\">the international trade within MNEs is not affected by indirect taxation<\/span>. It is <span style=\"color: #ff0000; background-color: #ffff00;\">a new form of VAT benefits which would be applied transnationally<\/span> within a MNEs,<\/p>\n<p><em>\u00ab\u00a0<span style=\"color: #993300;\">That the new rules be reconciled with the existing rules<\/span>\u00a0\u00bb .<\/em> If there is nothing to renegotiate, it is necessarily compatible with what currently in application.<em><br \/><\/em><\/p>\n<p><em>\u00ab\u00a0<span style=\"color: #993300;\">The new rules should not create distortions and should be effectively applicable to both profits and losses<\/span> (<a href=\"https:\/\/www.dagtva.com\/?page_id=9153\" target=\"_blank\" rel=\"noopener\">RBAtb<\/a>).\u00a0\u00bb <\/em> With the transactional taxation as is explained in the new calculation DAGTVA transfer pricing, <span style=\"color: #ff0000; background-color: #ffff00;\">States will be encouraged to move closer to a fiscal standard that, by definition, would be required in a global taxation system. All States in this agreement would be winners, it will be a \u201cwinners &#8211; winners\u201d system for the majority of them<\/span>.
